Slater's Trial Schedule for Ethicon Transvaginal Mesh Cases

Adam Slater is the attorney who took the Linda Gross case to trial last February where he secured the largest jury award yet granted to a mesh-injured woman $11.1 million.

Of that award $7.76 million was punitive, intended to punish Johnson & Johnson for its action. Background story here.

While that case remains on appeal by Johnson & Johnson (Ethicon), Slater tells Mesh News Desk that he is committed to taking more cases to trial against Ethicon. He does not favor any delays, if it is at all possible.

This is a bellwether case, meaning one of a selected few to be presented to a jury in the New Jersey cases. The Prolift is a mesh kit that Ethicon removed from the market in 2012, allegedly due to waning sales. The company never sought FDA approval before selling the Prolift claiming it was substantially similar to mesh already on the market.

This was the second generation of Prolift which was also removed from the market in mid 2012. An Ethicon spokesman told Ed Silverman’s Pharmalot that “this is not a product recall. We continue to have confidence in the safety and efficacy of these products. Our decision to discontinue these products is based on their commercial viability in light of changing market dynamics, and is not related to safety or efficacy.”

Monday, July 7, 2014 ~ Atlantic City, New Jersey~ TVT

This is the first bellwether case of the TVT (transvaginal tape mesh). This is a so-called "tension-free support" for incontinence, also made of polypropylene, as is most transvaginal mesh and hernia mesh. The TVT is still on the market here.

The TVT Secur was among the four meshes Ethicon announced it would remove from the market, phasing it out over the next year. Placed transvaginally for the treatment of stress urinary incontinence, Secur holds up the urethra to secure it in place to prevent involuntary leakage of urine.
